Short Term Rental 3-11

A Short Term Rental is defined as a one-family or multi-family dwelling with residentially allowed occupancy permits that are rented for a minimum of seven (7) days and a maximum thirty (30) days. Short term rentals establishments shall not include bed and breakfast establishments, motels, or hotels.

A special use is required prior to applying for a license or required permits. A special use permit shall not be issued unless the standards listed in Sec. 3-10-4 are met.

It shall be unlawful to engage in the business of operating a short-term rental, in the Village, without first having secured a license. Licenses are not transferable.

The term for licenses is for one year from January 1 - December 31, and the licenses must be renewed each year. License fees are non-refundable. Fees are as follows:

• Initial license fee= $2,000.00
• Renewal license fee= $2,000.00

Short Term Rental establishments shall be waived of all applicable Village Hotel Taxes and instead should pay the annual license fee.

Compliance with the regulations and requirements of the following are mandatory:

1. Life safety code
2. A smoke detector shall be installed in each guest room and on each building level, including the basement. One carbon monoxide detector shall be located on the first floor and at least one carbon monoxide detector is required within 15 feet of rooms used for sleeping. All said detectors shall be 110 volts with battery backup and interconnected.
3. All guest rooms shall post, inside the entry door, a floor plan showing the direction of travel and distance to the nearest exit.
4. Building and fire regulations.

• Compliance with all applicable Village building, electrical, fire, mechanical, and plumbing code regulations.

Annual inspections of a short-term rental shall be made by the Village of Oswego and the Oswego Fire Protection District if deemed necessary. Additional inspections can be required by the Village on an as needed basis.

The owner/operator of a short-term rental shall have a minimum of $1,000,000.00 in liability insurance which covers all short-term rental guests. A copy of such insurance coverage shall be submitted to the village with the application or renewal of license. The owner/operator will be required to notify the village of insurance cancellations.
